Terms of use

1. Subject of the service

Fair for Fitness is a free, independent information and comparison service for gyms in Germany. Use is free of charge; there is no entitlement to permanent availability of the service. We are neither an intermediary nor a contractual partner of the listed studios.

2. Information without warranty

Price, tariff and studio data come from publicly accessible sources and are prepared carefully, but provided without warranty as to accuracy, completeness and timeliness. Only the conditions of the respective studio are decisive; please check them yourself before signing a contract. Calculations such as the “effective cost” and the “Fair Score” are non-binding guide values based on the methodology disclosed in the methodology.

3. Rules for submitted content

If you submit content (e.g. reviews or studio entries via “Get involved”), you undertake to post only truthful, self-authored and legally compliant content. In particular, the following are prohibited:

• untrue factual claims, insults, abusive criticism or defamation;
• content that infringes the rights of third parties (copyright, trademark, personality rights);
• personal data of third parties (e.g. names of staff members);
• advertising, spam or automatically generated entries.

Reviews reflect the personal opinion of the respective author, not that of Fair for Fitness. You remain responsible for your content.

4. Grant of rights

By submitting, you grant us a simple, free-of-charge and territorially unlimited right to store, publish and (e.g. to shorten obvious errors) editorially edit the content for the purpose of presenting and promoting the service. You can request the deletion of your submission informally at any time.

5. Moderation and removal

We reserve the right to review, hide or delete content without prior notice if there is a reasonable suspicion of a violation of these terms or applicable law. We remove unlawful content immediately upon becoming aware of it. Send complaints to info@fair-for-fitness.de — via the “Report” link on each review you can reach us directly with the relevant case number.

6. Liability

Fair for Fitness is liable without limitation for damages arising from injury to life, body or health as well as for intent and gross negligence. In the case of simple negligence we are only liable for the breach of a material contractual obligation (cardinal obligation) and limited to the damage typically foreseeable for the contract. For external content (user contributions, linked pages) we are responsible under §§ 7–10 DDG only from the point of knowledge of a concrete legal violation. Any further liability is excluded.

7. Changes and applicable law

We may adapt these terms with effect for the future if this is necessary; the current version is available here. The law of the Federal Republic of Germany applies.
